Terms of Service

1. Parties to the contract
This contract is entered into between:

and the user who registers on the platform (hereinafter "user", "customer").
2. Acceptance of terms
By registering and using nothingsell, the user declares that they have read, understood and fully accepted these Terms of Service and the Privacy Policy. If you do not accept these terms, you may not use the platform.
3. Description of the service
nothingsell is a SaaS (Software as a Service) platform that aggregates data from PrestaShop and other analytics, advertising and SEO services (GA4, Google Ads, Meta Ads, Search Console, Merchant Center, Microsoft Clarity, PageSpeed), providing unified dashboards, automatic alerts and analysis features via AI (MCP — Model Context Protocol).
The service is provided "as is". We reserve the right to update, modify or discontinue features at any time, with reasonable notice.
4. Account and user responsibility
The user is responsible for the security of their account and access credentials. Sharing access with unauthorized parties is prohibited. Each account is personal and may not be transferred to third parties without the provider's written authorization. In the event of unauthorized access, the user must notify us immediately at info@ecommerce-manager.it.
5. Plans, pricing and payments
nothingsell offers a free plan (Free) and paid plans (Starter, Pro, Agency). Up-to-date prices are available on the Pricing page.
- • Paid plans are billed monthly in advance via Stripe.
- • Renewal is automatic unless explicitly cancelled before the expiry date.
- • Prices may be updated with 30 days' notice via email.
- • No refunds are provided for periods already billed, except for errors attributable to the provider.
- • Downgrade or cancellation takes effect at the end of the period already paid for.
6. Data ownership and integrations
All data connected via integrations (PrestaShop orders, GA4 data, advertising campaigns, etc.) remains the exclusive property of the user or their end customers. ECM di Tacchi Alessandro processes it solely to deliver the requested service and acts as data processor pursuant to art. 28 GDPR. The data is never sold, transferred or used for profiling or advertising purposes.
7. MCP service and AI integration
The MCP (Model Context Protocol) feature allows the user to connect the platform to third-party artificial intelligence models (e.g. Anthropic's Claude, OpenAI's GPT). The user is responsible for use compliant with the terms of the chosen AI providers. ECM di Tacchi Alessandro is not responsible for responses generated by AI models nor for business decisions taken on the basis of such responses. The data transmitted to the AI through the MCP protocol is limited to what is strictly necessary for the response requested by the user.
8. Limitations of liability
ECM di Tacchi Alessandro does not guarantee the continuity of the service or the absence of errors in data synchronized from third-party platforms (Google, Meta, PrestaShop, etc.). We are not responsible for interruptions caused by these providers. Our maximum liability towards the user is limited to the amount paid for the service in the 3 months preceding the event.
9. Acceptable use
It is prohibited to use nothingsell for illegal activities, to violate the rights of third parties, to gain unauthorized access to computer systems, or to overload the infrastructure in a manner disproportionate to the intended use. We reserve the right to suspend or terminate accounts that violate these terms, with prior notice except in cases of serious breach.
10. Cancellation and withdrawal
The user may cancel their account at any time from the profile settings or by writing to info@ecommerce-manager.it. Upon cancellation, data is deleted within 30 days, unless legal obligations apply.
For consumers (natural persons not acting in a commercial capacity), a 14-day right of withdrawal applies from subscription pursuant to Italian Legislative Decree 206/2005 (Consumer Code), unless the service has already been activated with explicit consent.
11. Applicable law and jurisdiction
These terms are governed by Italian law. For any dispute arising from the use of the service, the parties undertake to first seek an amicable solution within 30 days of notification of the problem. Failing agreement, the Court of Pesaro shall have exclusive jurisdiction, unless mandatory legal provisions for consumers provide otherwise.
